1. Introduction

These Terms of Service ("Terms", "Agreement") govern your access to and use of the Fastack website located at fastack.dev (the "Website") and the purchase and use of the Fastack SaaS boilerplate (the "Product" or "Service") provided by Fastack ("we", "us", "our", or "Fastack").

By accessing or using our Website, purchasing the Product, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Website or purchase our Product.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

2. Acceptance of Terms

By purchasing Fastack, accessing the private GitHub repository, downloading the codebase, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You represent and warrant that:

  • You are at least 18 years of age or have the legal capacity to enter into binding agreements
  • You have the authority to enter into this Agreement on behalf of yourself or your organization
  • All information you provide to us is accurate, current, and complete
  • You will comply with all applicable laws and regulations in your use of the Product

3. Description of Service

Fastack is a scalable, secured, production-ready SaaS boilerplate with solid foundations built for developers that includes:

  • Complete source code for a modern SaaS application
  • Access to a private GitHub repository containing the codebase
  • Comprehensive documentation and setup guides
  • Lifetime updates to the codebase
  • Email support
  • Commercial license for use in your projects

The Product is provided as-is and includes all features, components, and documentation as described at the time of purchase. We reserve the right to modify, update, or discontinue any features or services at any time, with or without notice.

4. Purchase and License

4.1 One-Time Purchase

Fastack is sold as a one-time purchase. Upon successful payment, you will receive:

  • Lifetime access to the private GitHub repository
  • All future updates and improvements to the codebase
  • A commercial license to use, modify, and distribute the code in your projects

4.2 License Grant

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, worldwide, perpetual license to:

  • Use the Fastack codebase in your commercial and personal projects
  • Modify, adapt, and customize the code to suit your needs
  • Create derivative works based on the Fastack codebase
  • Distribute your applications built with Fastack

4.3 License Restrictions

You may NOT:

  • Resell, redistribute, or sublicense the Fastack codebase as a template or boilerplate
  • Share your GitHub repository access credentials with others
  • Create a competing product that directly competes with Fastack
  • Remove copyright notices or attribution from the codebase
  • Use the Fastack name, logo, or branding in your products without permission
  • Reverse engineer or attempt to extract the source code in ways not intended by us

5. Payment Terms

5.1 Payment processing

All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms and conditions. We do not store your full payment card information on our servers.

5.2 Pricing

All prices are displayed in USD and are subject to change without notice. The price you pay is the price displayed at the time of purchase. We reserve the right to offer promotional pricing or discounts at our discretion.

5.3 Taxes

Prices displayed do not include applicable taxes, duties, or fees. You are responsible for paying any taxes, duties, or fees applicable in your jurisdiction. We are not responsible for determining or collecting such taxes.

5.4 Payment Information

You agree to provide accurate, current, and complete payment information. You are responsible for maintaining the security of your payment method and for all charges incurred through your account.

6. Access and Delivery

6.1 Repository Access

After successful payment, you will receive an email with instructions to access the private GitHub repository. Access is typically granted within 24 hours of purchase. You are responsible for:

  • Providing a valid GitHub account email address during purchase
  • Maintaining the security of your GitHub account
  • Not sharing your repository access with unauthorized parties

6.2 Updates

As part of your purchase, you will receive lifetime updates to the Fastack codebase. Updates may include bug fixes, new features, security patches, and improvements. Updates are delivered through the GitHub repository.

6.3 Availability

We strive to ensure the repository and documentation are available at all times, but we do not guarantee uninterrupted access. We reserve the right to perform maintenance, updates, or modifications that may temporarily affect availability.

7. Intellectual Property

7.1 Our Rights

The Fastack codebase, documentation, website content, logos, trademarks, and all related intellectual property are owned by Fastack or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You own the applications and projects you create using Fastack. However, you do not own the Fastack codebase itself. You may use, modify, and distribute your applications built with Fastack, but you may not redistribute the Fastack codebase as a template or boilerplate.

7.3 Third-Party Components

Fastack may include third-party open-source components, libraries, or dependencies. These components are subject to their respective licenses, which you must comply with. We are not responsible for the licensing terms of third-party components.

8. User Obligations

You agree to:

  • Use the Product in compliance with all applicable laws and regulations
  • Respect intellectual property rights and not infringe upon the rights of others
  • Maintain the confidentiality of your repository access credentials
  • Not use the Product for any illegal, harmful, or fraudulent purposes
  • Not attempt to gain unauthorized access to our systems or other users' accounts
  • Not interfere with or disrupt the operation of our services
  • Provide accurate information when making a purchase or contacting support

9. Prohibited Uses

You are expressly prohibited from:

  • Reselling, redistributing, or sublicensing the Fastack codebase as a template or boilerplate
  • Creating a competing SaaS boilerplate product based on Fastack
  • Sharing your GitHub repository access with unauthorized users
  • Using Fastack to create content that is illegal, harmful, discriminatory, or violates others' rights
  • Reverse engineering, decompiling, or disassembling the codebase beyond normal customization
  • Removing copyright notices, attribution, or license information from the codebase
  • Using Fastack trademarks, logos, or branding without explicit written permission
  • Attempting to circumvent security measures or access restrictions

10. Refund Policy

Due to the digital nature of the Product and immediate access to the codebase upon purchase, we have a strict no-refund policy. All sales are final.

We do not offer refunds for:

  • Change of mind or dissatisfaction with the Product
  • Inability to use the Product due to technical limitations
  • Failure to read documentation or understand the Product before purchase
  • Compatibility issues with your development environment

However, we may consider refunds in exceptional circumstances, such as:

  • Duplicate purchases (accidental multiple purchases)
  • Technical issues preventing access that we cannot resolve
  • Material misrepresentation of the Product's features or capabilities

Refund requests must be submitted within 7 days of purchase via our contact form. All refund decisions are at our sole discretion.

11. Support

We provide email support to help you with questions about Fastack. Support includes:

  • Assistance with setup and installation
  • Clarification of documentation
  • Help with general usage questions
  • Bug reports and technical issues

Support does NOT include:

  • Custom development or feature implementation
  • Debugging of your custom code or modifications
  • Deployment assistance or server configuration
  • Third-party integration support
  • Training or educational services

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Product or our services at any time, with or without notice. This includes:

  • Adding, removing, or modifying features
  • Changing the structure or organization of the codebase
  • Updating dependencies or third-party components
  • Modifying documentation or support offerings

We are not obligated to maintain backward compatibility or support older versions of the codebase. However, you will continue to have access to the version you purchased and all updates we provide.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FASTACK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Costs of substitute products or services
  • Damages resulting from use or inability to use the Product
  • Security breaches or unauthorized access to your systems
  • Errors, bugs, or defects in the codebase

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

14. Disclaimer of Warranties

THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Product will meet your requirements or expectations
  • Warranties that the Product will be error-free, secure, or uninterrupted
  • Warranties regarding the accuracy, reliability, or completeness of the Product

We do not warrant that the Product will be compatible with all systems, environments, or third-party services. You are responsible for ensuring compatibility with your development environment and infrastructure.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fastack and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Product
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your infringement of any intellectual property or other rights
  • Content or applications you create using Fastack

16. Termination

16.1 Termination by You

You may stop using the Product at any time. However, termination does not affect your license to use the codebase you have already downloaded or cloned from the repository.

16.2 Termination by Us

We reserve the right to suspend or terminate your access to the repository and our services immediately, without notice, if you:

  • Violate these Terms or our Privacy Policy
  • Engage in fraudulent, illegal, or harmful activities
  • Share your repository access with unauthorized parties
  • Attempt to resell or redistribute the Fastack codebase
  • Infringe upon our intellectual property rights

16.3 Effect of Termination

Upon termination, your right to access the repository and receive updates will cease immediately. However, you may continue to use any code you have already downloaded in accordance with the license granted in these Terms.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

17.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Product shall be resolved through good-faith negotiation. If we cannot resolve a dispute through negotiation, you agree to first contact us via our contact form to attempt to resolve the issue.

If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts located in Belgium.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fastack regarding the Product and supersede all prior agreements, understandings, or communications, whether written or oral.
